  • Any dispute, controversy, or claim arising out of or relating to this agreement, including the breach, termination, or validity thereof, shall be settled by arbitration in accordance with the rules of Arbitration and Conciliation Act, 1996, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
  • The arbitration shall be conducted by one (01) arbitrator who shall be appointed mutually by both the parties. The seat of arbitration shall be New Delhi, India.
  • Each party shall bear its own costs in connection with the arbitration proceedings, and the parties shall share equally the fees and expenses of the arbitrator(s).
  • Notwithstanding the foregoing, either party may seek preliminary injunctive relief in a court of competent jurisdiction if, in its reasonable judgment, such action is necessary to avoid irreparable harm.
